APPROVAL OF LAST MONTH’S MINUTES
On a motion made by Mr.
Nalevanko and seconded by Rev. McClain, the Commission voted 3-0 to accept the
Minutes of the January 12, 2005 meeting as written.
CITIZEN’S PARTICIPATION
Robert McAndrew, Scranton Police Department requested to have the
Commission permit him to take the written Lieutenant Promotion Test that was
given on January 28, 2005, stating that he could not remember if he had prior
notice of the sign-up period or not. Mr.
McAndrew relied on e-mails to Union President Stulgis and Chief Elliott in
support of his position. Chairman Bubser
discussed with Mr. McAndrew his displeasure with a telephone call made by
McAndrew to the Bubser residence the night before the exam, whereby McAndrew
made innuendos regarding past felonies with the Civil Service process, used
profanity, and then abruptly hung up the telephone. Mr. McAndrew acknowledged making the
telephone call, but didn’t recall using any profanities. Mr. Bubser reiterated
the posting process announcing the sign-up deadlines and Mr. McAndrew admitted
he “heard about tests” but wasn’t sure if he was “on vacation when the
announcements were posted”. Mr. McAndrew
admitted that he knew about the Captain’s Promotional Test, which was posted on
the same bulletin board as the Lieutenant’s Promotional Test announcement, and
that he in fact signed up for and took the Captain’s Promotional Test given on
January 14, 2005.
Mr. McAndrew again
requested that a make-up test be given to him and stated that Chief Elliott
advised him to go to the Civil Service meeting and orally request a make-up
test. Mr. McAndrew stated that the Chief
told him not to appear at the January 28, 2005 test because “they won’t let you
in”, and that Chief Elliott told him “go to the next Civil Service meeting and
bring your e-mails with you and they (Civil Service Commission) will let you
take the test”.
Mr. Bubser and
Solicitor Kelly advised Mr. McAndrew that any request for a make-up exam must
be put in writing and presented to the Commission. At the conclusion of the
meeting, Mr. McAndrew did return with his request in writing to the commission.
Paul Schirra, Scranton Fire Bureau, opined that his name must
remain on an active Lieutenant List. Mr.
Schirra advised he would put his opinion in writing.
CORRESPONDENCE
Michael Marino
requested his $75.00 deposit to be refunded for his failure to appear at the
Firefighter Entry Exam, due to the death of a close friend. A motion to approve the request was made by
Rev. McClain and seconded by Mr. Nalevanko.
The motion passed 3-0. Solicitor
Kelly was requested to send a memo to Mr. Killeen in the Human Resources
Department to issue the refund.
Solicitor Kelly
presented his monthly budget-approved bill for services to the Commission. A motion was made by Mr. Nalevanko and
seconded by Rev. McClain to accept and approve the bill. The motion passed 3-0.
OLD BUSINESS
Chairman Bubser stated
that oral examinations will be administered to the Firefighter Entry applicants
who passed the Strength and Agility Test on February 22, 2005. Public Safety Director Hayes advised that two
(2) professionals from outside the City would be on the Oral Panel.
Mr. Bubser then
indicated that a Special Meeting to certify the Firefighter Entry Test List and
Police Captain and Juvenile Officer Lists will be scheduled for February 24,
2005 at 5:30 p.m.
The Commission reviewed
the revised Promotion Lists after promotions were made to the Captain,
Lieutenant and Chauffeur lists. On a
motion made by Mr. Nalevanko and seconded by Rev. McClain, the Commission voted
3-0 to revise and post the lists.
NEW BUSINESS
Solicitor Kelly read a
proposed Resolution which revises and amends Section VIII, 2 of the Civil
Service Rules. A motion was made by Rev.
McClain to accept and execute the Resolution.
The motion was seconded by Mr. Nalevanko and the same carried in a vote
of 3-0. A copy of the Resolution is
attached and incorporated into these Minutes.

A motion was made and
seconded to adjourn. The meeting
adjourned at 6:10 p.m.
